A bench headed by Justice Tariq Saleem Shaikh and Justice Anwar Haq delivered the verdict following petitions filed by Khan against his physical remand. During the court proceedings, Prosecutor General Punjab Farhad Ali Shah presented his arguments. At one point, Justice Shaikh questioned the need for a photographic test of the accused. He remarked that you cannot force the accused to undergo the photographic test.
Similarly, Justice Anwar-ul-Haq expressed his reservations on the use of modern investigative tools. He asked, “When did it occur to you that you should turn to modern instruments for investigation?”
The Prosecutor General argued that the test facility is available only inside the jail and not outside. He claimed that it would be unfair to deny the prosecution full opportunity. Shah said that Khan has created a certain narrative through his tweets. According to him, it would be impossible to recover the mobile phones used for these tweets or WhatsApp messages without questioning Khan.
Justice Haqprast questioned that mobile phones are recovered when the accused is in jail. He asked that when the accused is in jail, how will the mobile phone be recovered?
After considering these arguments, the Lahore High Court declared the physical remand of Khan unjustified in 12 cases. The court also quashed the notification requiring Khan’s attendance through video link.
